1. Acceptance of Terms

Welcome to Daily Locks AI ("Service"), operated by Hoyne Labs LLC ("Company," "we," "us," or "our"), an Illinois limited liability company. By accessing or using our website at dailylocks.ai, mobile applications, or any related services, you ("User," "you," or "your") agree to be bound by these Terms & Conditions ("Terms").

PLEASE READ THESE TERMS CAREFULLY. By using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a new "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

2. Eligibility

Age Requirement

You must be 21 years of age or older to use this Service.

By using the Service, you represent and warrant that:

  • You are at least 21 years of age;
  • You have the legal capacity to enter into a binding agreement;
  • You are not located in a jurisdiction where use of this Service or sports betting is prohibited;
  • You will comply with all applicable local, state, national, and international laws and regulations;
  • You have not previously been suspended or removed from the Service.

IMPORTANT: Sports betting may not be legal in your jurisdiction. It is solely your responsibility to determine whether sports betting is legal in your location before engaging in any wagering activity.

3. Nature of Service

Daily Locks AI is an information and entertainment service. We provide:

  • Sports betting data analysis and statistics;
  • Historical betting outcome information;
  • AI-powered insights and pattern recognition;
  • Expected value calculations and projections;
  • Educational content about sports betting strategy.

WE ARE NOT:

  • A sportsbook or gambling operator. We do not accept bets, wagers, or any form of gambling transactions.
  • Licensed by any gaming commission. As an information service, we are not required to hold a gambling license.
  • Financial or investment advisors. Our content is for informational and entertainment purposes only.
  • Guaranteeing any betting outcomes. Past performance does not guarantee future results.

Our service is similar in nature to sports analysis provided by ESPN, The Athletic, CBS Sports, or other sports media outlets. We provide information; you make your own decisions about whether and how to use that information.

4. Assumption of Risk

IMPORTANT: PLEASE READ CAREFULLY

BY USING THIS SERVICE, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

  1. Sports betting involves substantial risk of financial loss. You may lose some or all of the money you wager. Gambling should never be viewed as a way to make money or solve financial problems.
  2. You assume all risk of financial loss. Any betting decisions you make are your own. Hoyne Labs LLC is not responsible for any losses you incur from sports betting, regardless of whether you used information from our Service.
  3. No guarantee of accuracy or results. Our AI-generated analysis, picks, recommendations, and calculations may contain errors. Historical data and patterns do not guarantee future outcomes.
  4. You are solely responsible for your wagering decisions. The decision to place any bet, the amount wagered, and the sportsbook used are entirely your choices and your responsibility.
  5. Past performance does not predict future results. Any statistics about past winning bets, profit calculations, or success rates are historical only and do not indicate future performance.

BY CONTINUING TO USE THIS SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS ASSUMPTION OF RISK, UNDERSTAND IT, AND VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH SPORTS BETTING.

5. Account Rules

5.1 Account Registration

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

5.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

5.3 One Account Per Person

Each individual may maintain only one account. Creating multiple accounts may result in termination of all accounts and forfeiture of any paid subscription fees.

5.4 Account Termination

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms. You may also delete your account at any time by contacting us at hoynelabs@gmail.com.

6. Prohibited Conduct

You agree NOT to:

  • Share, resell, or redistribute any picks, analysis, or content from the Service to third parties;
  • Use automated systems (bots, scrapers, etc.) to access the Service;
  • Circumvent any access restrictions, usage limits, or security measures;
  • Use the Service for any illegal purpose or in violation of any laws;
  • Attempt to gain unauthorized access to our systems, other users' accounts, or any computer networks;
  • Impersonate any person or entity or misrepresent your affiliation;
  • Post or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable;
  • Interfere with the proper functioning of the Service;
  • Create derivative works based on our content without express written permission.

Violation of these prohibitions may result in immediate account termination without refund.

7. Subscriptions & Billing

7.1 Subscription Plans

We offer various subscription plans with different features and query limits. Current pricing is available on our website. We reserve the right to modify pricing at any time, with changes effective at the start of your next billing cycle.

7.2 Automatic Renewal

AUTO-RENEWAL DISCLOSURE

All paid subscriptions automatically renew at the end of each billing period (monthly) until canceled. You will be charged the then-current subscription rate at each renewal. You authorize us to charge your payment method on file for recurring subscription fees.

7.3 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us at hoynelabs@gmail.com. Cancellation will take effect at the end of your current billing period. You will retain access to paid features until then.

7.4 Payment Processing

Payments are processed through third-party payment processors. By providing payment information, you authorize us to charge your payment method for all fees incurred. You are responsible for keeping your payment information current.

8. Refund Policy

ALL SALES ARE FINAL

Due to the nature of our digital information service, all subscription payments are generally non-refundable.

Limited Exception for First-Time Subscribers

If you are a first-time subscriber and are unsatisfied with the Service, you may request a refund within 48 hours of your initial payment. This exception applies only to:

  • First-time subscribers only (not previous subscribers who canceled);
  • The initial payment only (not renewals);
  • Requests made within 48 hours of payment.

Refund requests are evaluated at our sole discretion. To request a refund, email hoynelabs@gmail.com with your account email and reason for the request.

No Refunds For:

  • Betting losses or unsuccessful picks;
  • Partial months of service;
  • Renewal payments;
  • Accounts terminated for Terms violations;
  • Requests made after 48 hours of initial payment.

9. Privacy Policy

9.1 Information We Collect

  • Account Information: Email address, password (encrypted), name (optional);
  • Payment Information: Processed by third-party payment processors; we do not store full credit card numbers;
  • Usage Data: Queries submitted, features used, timestamps, IP addresses;
  • Device Information: Browser type, operating system, device identifiers;
  • Cookies: Session cookies, preference cookies, analytics cookies.

9.2 How We Use Information

  • To provide and improve the Service;
  • To process payments and manage subscriptions;
  • To communicate with you about the Service;
  • To enforce our Terms and prevent fraud;
  • To analyze usage patterns and improve user experience;
  • To comply with legal obligations.

9.3 Information Sharing

We do not sell your personal information. We may share information with:

  • Service providers (payment processors, hosting, analytics);
  • Law enforcement when required by law;
  • In connection with a business transfer or acquisition.

9.5 Data Security

We implement reasonable security measures to protect your information. However, no method of transmission over the Internet is 100% secure. You use the Service at your own risk.

10. Limitation of Liability

10.1 No Liability for Betting Losses

HOYNE LABS LLC IS NOT LIABLE FOR ANY BETTING LOSSES OR GAMBLING-RELATED DAMAGES. You acknowledge that any wagering decisions are made at your sole risk and that we have no responsibility for any losses you incur.

10.2 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

10.3 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL HOYNE LABS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or data;
  • Gambling or betting losses;
  • Errors in AI-generated content;
  • Service interruptions or unavailability;
  • Third-party actions or conduct.

10.4 Maximum Liability

IN ANY EVENT, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

11. Notice to Illinois Residents

Hoyne Labs LLC is organized under the laws of the State of Illinois. We provide the following notices to Illinois residents:

  • Not a Licensed Gaming Operator: Hoyne Labs LLC is not licensed by the Illinois Gaming Board. As an information and entertainment service that does not accept wagers or operate gambling activities, we are not required to hold any gaming license.
  • Sports Betting Legality: Sports betting was legalized in Illinois in 2019 under the Sports Wagering Act. If you are an Illinois resident, you may only place sports bets through licensed operators. Daily Locks AI is not a licensed operator.
  • Problem Gambling Resources: Illinois residents experiencing gambling problems can contact the Illinois Council on Problem Gambling at 1-800-GAMBLER (1-800-426-2537) or visit www.ilgamblingproblem.org.

12. Dispute Resolution & Arbitration

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions.

12.2 Binding Arbitration

ARBITRATION AGREEMENT

You and Hoyne Labs LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration, rather than in court, except that either party may seek injunctive relief in court for intellectual property infringement.

Arbitration shall be conducted by a single arbitrator in Cook County, Illinois, in accordance with the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding.

12.3 Class Action Waiver

YOU AGREE THAT ANY CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

12.4 Small Claims Court

Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdiction.

12.5 Opt-Out Right

You may opt out of this arbitration agreement by sending written notice to hoynelabs@gmail.com within 30 days of first accepting these Terms. The notice must include your name, address, and a clear statement that you wish to opt out of arbitration.

13. General Provisions

13.1 Entire Agreement

These Terms constitute the entire agreement between you and Hoyne Labs LLC regarding the Service and supersede all prior agreements.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

13.4 Assignment

You may not assign these Terms without our written consent. We may assign these Terms at any time without notice.
